This Privacy Policy explains how Dakotah Harding, doing business as First Night Puppy ("First Night Puppy", "we", "us", "our"), collects, uses, shares and protects your personal information when you visit firstnightpuppy.com, buy from us, or contact us. It also explains the rights you have over your information and how to exercise them.
By using our store you agree to this policy. If you do not agree, please do not use the site.
1. Who we are
First Night Puppy is a sole proprietorship operated by Dakotah Harding in Caldwell, Ohio, United States. We sell one product: a heartbeat-and-warmth comfort plush for puppies. We pick, pack and ship every order ourselves.
For privacy purposes, we are the "data controller" of the information described below.

2. Information we collect
Information you give us directly
- Order information: your name, email address, shipping address, billing address, phone number, and the details of what you ordered.
- Account information, if you create an account: your name, email address and password.
- Communications: anything you send us by email, through a contact form, or in a product review, including the content of your message.
- Marketing preferences: your email address if you choose to subscribe to our emails.
Payment information
Payments are processed by Shopify Checkout and its payment providers. Your full card number is entered directly into their systems. We never see, receive or store full payment card numbers. We receive only confirmation that payment succeeded, and limited details such as the card brand and last four digits for order support and fraud prevention.
Information collected automatically
When you visit the site, we and our service providers automatically collect:
- your IP address and approximate location derived from it;
- your device type, operating system and browser;
- the pages you view, the links you click, and how long you stay;
- the site or advertisement that referred you to us.
This is collected using cookies and similar technologies. See section 5.
Information we do not collect
We do not knowingly collect sensitive personal information such as government identifiers, health information, biometric data, or precise geolocation. Please do not send us such information.
3. How we use your information
We use personal information to:
- process, fulfil and ship your order, and send you order and shipping updates;
- provide customer support and respond to your questions;
- process returns, replacements and refunds under our refund policy;
- detect, prevent and investigate fraud, abuse and security incidents;
- understand how the site is used so we can improve it;
- send you marketing emails, but only if you have opted in, and you can unsubscribe at any time using the link in any marketing email;
- publish product reviews you choose to submit; and
- meet our legal, tax and accounting obligations.
If you are in the EU or UK, our legal bases for processing are: performance of a contract (fulfilling your order), our legitimate interests (running and securing the store, improving the site, preventing fraud), your consent (marketing email and non-essential cookies), and compliance with a legal obligation.
4. Who we share it with
We share personal information only with service providers who help us run the store, and only as needed for them to perform their function:
- Shopify Inc. — hosting our store, processing checkout and payments, and providing store analytics. Shopify's own privacy policy governs its handling of that data.
- Payment providers — processing card payments through Shopify Checkout.
- Shipping carriers — delivering your order and providing tracking.
- Judge.me — collecting and displaying product reviews, including sending review-request emails to customers.
- Email and analytics providers — sending transactional and marketing email, and measuring site usage.
We may also disclose information where we are required to by law, in response to a valid legal request, to enforce our terms, to protect the rights or safety of any person, or in connection with a sale or transfer of the business.
We do not sell your personal information, and we do not share it for cross-context behavioural advertising, as those terms are defined under California law.
5. Cookies and tracking
Cookies are small files stored on your device. We use:
- Essential cookies, which are required for the site to work — keeping items in your cart, keeping you signed in, and completing checkout securely. The store cannot function without these.
- Analytics cookies, which help us understand how visitors use the site so we can improve it.
You can manage non-essential cookies through the cookie banner on our site and through your browser settings. Blocking essential cookies will prevent checkout from working.
We currently do not run advertising or social media tracking pixels on this site. If that changes, we will update this policy and the cookie banner before those technologies are enabled.
6. How long we keep it
We keep order records for as long as needed to fulfil the order and then for the period required by tax and accounting law, generally seven years. We keep marketing subscriber information until you unsubscribe. We keep support emails for as long as needed to resolve the issue and for a reasonable period afterwards. Analytics data is retained in aggregated or de-identified form.
7. Your rights
Depending on where you live, you may have the right to:
- access the personal information we hold about you;
- correct information that is inaccurate or incomplete;
- delete your personal information;
- receive a copy of your information in a portable format;
- opt out of marketing email at any time;
- opt out of the sale or sharing of personal information, and of targeted advertising — note that we do not sell or share personal information in the first place; and
- not be discriminated against for exercising any of these rights.
If you are in California, these rights arise under the CCPA as amended by the CPRA. If you are in the EU or UK, they arise under the GDPR, and you also have the right to object to processing based on legitimate interests, to withdraw consent at any time, and to lodge a complaint with your local data protection authority.
To exercise any right, email firstnightpuppy@gmail.com with the subject line "Privacy request". We will respond within the time the law allows — generally 45 days in California and 30 days under the GDPR. We may need to verify your identity before acting, usually by confirming order details you already provided.
You may use an authorised agent to make a request on your behalf, subject to verification.
8. Children
Our store is intended for adults. It is not directed at children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information, email firstnightpuppy@gmail.com and we will delete it.
9. Security
We use Shopify's hosted, PCI-compliant infrastructure, and the site is served over HTTPS. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we take reasonable steps to protect your information and to limit who can access it.
10. International transfers
We operate in the United States and our service providers may process information in the United States and other countries. If you are in the EU or UK, your information may be transferred outside your country. Where required, our providers rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses.
11. Third-party links
Our site and our guides may link to other websites. We are not responsible for the privacy practices of those sites, and this policy does not apply to them.
12. Changes to this policy
We may update this policy as our store changes or as the law requires. When we do, we will revise the "Last updated" date above. Material changes will be highlighted on this page. Please check back from time to time.
