Agreement. By using firstnightpuppy.com or placing an order, you agree to these Terms.

Orders. Your order is an offer to buy. We may accept or decline any order. We accept your order when we ship it. All prices are in USD.

Pricing errors. If an item is listed at the wrong price due to a typo or system error, we may cancel or correct the order and refund you in full, even after a confirmation email.

Product use and safety. First Night Puppy is a comfort aid, not a medical device, and makes no health or veterinary claims. It is not a chew toy — supervise your puppy, and follow all safety guidance on the product page and packaging, including battery and heat-pack warnings.

Age and eligibility. You must be at least 18 and able to form a binding contract to order from us.

Reviews and submissions. If you submit a review, photo or other content, you confirm it reflects your genuine experience and that you own or have permission to use it. You grant us a non-exclusive, royalty-free licence to display it in connection with the product. We may decline or remove content that is unlawful, misleading or not a genuine customer experience. We do not edit or suppress reviews on the basis of their rating.

Acceptable use. Don't use the site to break the law, interfere with its operation, scrape it at scale, or attempt to access accounts or systems you aren't authorised to.

Intellectual property. All content on this site is owned by Dakotah Harding, doing business as First Night Puppy, and may not be copied or reused without permission.

Third-party services. Checkout, payments, hosting and reviews are provided by third parties including Shopify and Judge.me, and are subject to their own terms.

Disclaimer. The site and product are provided "as is". To the fullest extent allowed by law, we disclaim implied warranties, except those that cannot be excluded under applicable law.

Limitation of liability. To the fullest extent allowed by law, Dakotah Harding, doing business as First Night Puppy, is not liable for indirect or consequential damages, and our total liability for any claim is limited to the amount you paid for the product.

Changes to these Terms. We may update these Terms. The version in force is the one published at the time you place your order.

Severability. If any provision is found unenforceable, the rest remain in effect.

Governing law. These Terms are governed by the laws of the State of Ohio, and any dispute will be handled in the state or federal courts located in Ohio.
